Nominations to the Advisory Committee on Blood Safety and

Availability

ACTION: Notice.

SUMMARY: The Office of Public Health and Science (OPHS) is seeking

nominations of qualified individuals to be considered for appointment

as members of the Advisory Committee on Blood Safety and Availability

(ACBSA). ACBSA is a Federal advisory committee in the Department of

Health and Human Services. Management support for the activities of

this Committee is the responsibility of the OPHS.

    The qualified individuals will be nominated to the Secretary of

Health and Human Services for consideration of appointment as members

of the ACBSA. Members of the Committee, including the Chair, are

appointed by the Secretary. Members are invited to serve on the

Committee for up to four-year terms.

Schedule V

ACTION: Final rule.

SUMMARY: With the issuance of this final rule, the Deputy Administrator

of the DEA places the substance lacosamide [(R)-2-acetoamido-N-benzyl-

3-methoxy-propionamide] and any material, compound, mixture, or

preparation which contains any quantity of lacosamide into schedule V

of the Controlled Substances Act (CSA). As a result of this rule, the

regulatory controls and criminal sanctions of schedule V will be

applicable to the manufacture, distribution, dispensing, importation

and exportation of lacosamide.

DATES: Effective Date: This rule is effective June 22, 2009.

Schedules of Controlled Substances: Placement of Tapentadol Into

Schedule II

ACTION: Final rule.

SUMMARY: With the issuance of this final rule, the Deputy Administrator

of the Drug Enforcement Administration (DEA) places the substance

tapentadol, including its isomers, esters, ethers, salts and salts of

isomers, esters and ethers whenever the existence of such isomers,

esters, ethers, and salts is possible, into schedule II of the

Controlled Substances Act (CSA). As a result of this rule, the

regulatory controls and criminal sanctions of schedule II will be

applicable to the manufacture, distribution, dispensing, importation,

and exportation of tapentadol and products containing tapentadol.

DATES: Effective Date: June 22, 2009.

ACTION: Notice of proposed rulemaking; reopening of comment period.

SUMMARY: The Department of Health and Human Services (DHHS) is

reopening the comment period until June 19, 2009 concerning the

proposed rule for Approval Tests and Standards for Closed-Circuit

Escape Respirators that was published in the Federal Register on

Wednesday, December 10, 2008 (73 FR 75027). The previous comment period

closed on April 10, 2009.

ACTION: Notice of proposed rulemaking; reopening of comment period.

SUMMARY: The Department of Health and Human Services (DHHS) is

reopening the comment period until October 9, 2009 for the Notice of

Proposed Rulemaking on Quality Assurance Requirements for Respirators

that was published in the Federal Register on Wednesday, December 10,

2008 (73 FR 75045). The comment period previously closed on April 10,

Medicare Program; Proposed Changes to the Hospital Inpatient

Prospective Payment Systems for Acute Care Hospitals and Fiscal Year

2010 Rates and to the Long-Term Care Hospital Prospective Payment

System and Rate Year 2010 Rates

ACTION: Proposed rule.

SUMMARY: We are proposing to revise the Medicare hospital inpatient

prospective payment systems (IPPS) for operating and capital-related

costs of acute care hospitals to implement changes arising from our

continuing experience with these systems, and to implement certain

provisions made by the Medicare Improvements for Patients and Providers

Act of 2008 (MIPPA, Pub. L. 110-275) and the American Recovery and

Reinvestment Act of 2009 (ARRA, Pub. L. 111-5). In addition, in the

Addendum to this proposed rule, we describe the proposed changes to the

amounts and factors used to determine the rates for Medicare acute care

hospital inpatient services for operating costs and capital-related

costs. These proposed changes would be applicable to discharges

occurring on or after October 1, 2009. We also are setting forth the

proposed update to the rate-of-increase limits for certain hospitals

excluded from the IPPS that are paid on a reasonable cost basis subject

to these limits. The proposed updated rate-of-increase limits would be

effective for cost reporting periods beginning on or after October 1,

2009.

    In addition, we are proposing to update the annual payment rates

for the Medicare prospective payment system (PPS) for inpatient

hospital services provided by long-term care hospitals (LTCHs). In the

Addendum to this proposed rule, we also set forth the proposed changes

to the payment rates, factors, and other payment rate policies under

the LTCH PPS for rate year 2010. These proposed changes would be

applicable to discharges occurring on or after October 1, 2009. In this

proposed rule, we also note those provisions of the ARRA that amended

provisions of the Medicare, Medicaid, and SCHIP Extension Act of 2007

(MMSEA, Pub. L. 110-173) relating to payments to LTCHs and new LTCHs

and LTCH satellite facilities, and increases in beds in existing LTCHs

and LTCH satellite facilities under the LTCH PPS that will be

implemented in the final rule issued for this proposed rule.

Health Accreditation Program for Continued Deeming Authority for

Hospices

ACTION: Proposed notice.

SUMMARY: This proposed notice acknowledges the receipt of a deeming

application from the Community Health Accreditation Program (CHAP) for

continued recognition as a national accrediting organization for

hospices that wish to participate in the Medicare or Medicaid programs.

The statute requires that within 60 days of receipt of an

organization's complete application, we publish a notice that

identifies the national accrediting body making the request, describes

the nature of the request, and provides at least a 30-day public

comment period.

Medicare Program; Public Meeting in Calendar Year 2009 for New

Clinical Laboratory Tests Payment Determinations

ACTION: Notice.

SUMMARY: This notice announces a public meeting to receive comments and

recommendations (and data on which recommendations are based) from the

public on the appropriate basis for establishing payment amounts for a

specified list of new Clinical Procedural Terminology (CPT) codes for

clinical laboratory tests in calendar year (CY) 2010. The meeting

provides a forum for interested parties to make oral presentations and

submit written comments on the new codes that will be included in

Medicare's Clinical Laboratory Fee Schedule for CY 2010, which will be

effective on January 1, 2010. The development of the codes for clinical

laboratory tests is largely performed by the CPT Editorial Panel and

will not be further discussed at the Centers for Medicare & Medicaid

Services (CMS) meeting.
